Indiana Shared Parenting.org provides information
for the support of introducing a presumptive Shared Parenting bill
to the Indiana General Assembly. Presumptive Shared Parenting would,
by statute, require judges in Indiana custody cases in the Indiana
courts to confer the right of parents to access to their children as
guaranteed by the U.S. Constitution. Judges would be required to
presume that both fit parents are entitled to continue a
relationship with their child(ren) following a separation or
divorce. We are seeking to bring together people who would like to
coordinate their efforts in the legislative process of Shared
Parenting bills.
Shared Parenting may also be known as 50/50 Parenting, Equal Shared Parenting or Equal Joint Custody. Our bill seeks to make Shared Parenting the presumption or default custodial arrangement in cases involving child custody. The Indiana Supreme Court endorses presumptive Shared Parenting, scientific studies have continued to show that children are better adjusted after separation in Shared Parenting situations and presumptive Shared Parenting is already the law in six states.
We are mothers, fathers, grandparents and other advocates concerned about child welfare. We recognize the research that states children do best in the sole custody of the father following separation or divorce but feel that decision should be left to the parties involved in the individual cases. Both mothers and fathers should enter the courtroom with the presumption that they are both fit to equally provide for the care and support of their child(ren) which can only be rescinded through a clear and convincing showing of unfitness.
